I will observe and obey all posted and understood rules and warnings and further agree to follow any oral instructions or directions given by a Dreamers representative. If, however, I observe any unusual significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the nearest Dreamers Representative immediately.2. ASSUMPTION OF RISK. Participation in or attendance at the Event involves inherent risks and dangers of accidents, personal and bodily injury (including death and/or illness) and property loss or damage, and minor to severe economic or noneconomic losses. I recognize that severe injuries, including permanent paralysis or death can occur in sports or activities involving height or motion, the activities including but not limited to breath work, training routines with ice/cold/heat, extreme cold, ice baths, weather conditions, condition of participants, equipment, or other factors. Potential injuries include but are not limited to heart failure, loss of consciousness, and stroke and may be caused by extreme cold, ice baths, weather conditions, condition of participants, equipment, or other factors. These may result from Participant’s own actions or inactions or negligence, as well as the actions or inactions or negligence of others. There may be other risks not known to me and not reasonably foreseeable at this time. I understand and I have considered and evaluated the nature, scope and extent of the risks involved, and Participant or Parent/Guardian voluntarily chooses to assume all such risks, both known and unknown, even those risks that result from the negligence of the Released Parties (defined below) or others and assume full responsibility for my participation in the Event.I warrant that Participant is physically and mentally able to participate in the Event and any post-event activities, including, but not limited to cold plunging, saunas, social drinking, games, and more. While particular rules, equipment, and personal discipline may reduce this risk, the risk of serious injury still does exist. I knowingly and freely assume all such risks, both known and unknown, even if arising from the negligence of Plunge or others such as volunteers and trainers, and I assume full responsibility for my participation. I consent to treatment of Participant in the event of an emergency or other incident in which, in the reasonable judgment of the on-site personnel, Participant requires medical care. I further agree to pay all costs associated with such medical care and to indemnify and hold harmless the Released Parties (defined below) from any costs or claims arising from such medical care.3. RELEASE FROM LIABILITY. I, for myself and on behalf of my heirs, estate, insurers, successors and assigns, fully and forever release and discharge Dreamers Run Club and the affiliates and subsidiaries of Dreamers Run Club, their respective officers, directors, shareholders, employees, agents, distributors, representatives, contractors, successors, assigns, and insurers, all Event sponsors, advertisers, volunteers, and staff, and all owners or lessors of premises used in connection with an Event (hereinafter, “Released Parties”), from any and all injuries (including death and/or illness), losses, damages, claim (including negligence claims), demands, lawsuits, expenses, and any other liability of any kind, of or to me, my property, or any other person, directly or indirectly arising out of or in connection with my participation in or attendance at the Event.4. AGREEMENT NOT TO FILE SUIT OR OTHER CLAIMS. Participant or Parent/Guardian agrees not to sue or otherwise seek relief or damages from the Released Parties for any and all injuries (including death and/or illness), property loss or damage, and minor to severe economic or noneconomic losses, incurred directly or indirectly in connection with an Event.5. AUTHORIZATION TO RECORD AND TO USE RECORDINGS AND NAME. I hereby grant to Dreamers Run and permission to use, photograph, video record and otherwise record Participant’s or Parent/Guardian’s image, voice, avatar, name, biographical data, silhouette, body dimension, shape, posture, or any other aspect of the recording at the Event (collectively the “Recording”), and the right to use all or any portion of the Recording or the results thereof, in all media and in any manner now known or hereafter developed, in connection with the Event or otherwise without any additional consideration. I represent that it is not necessary for Dreamers Run Club to obtain permission from me other than as contained in this Waiver or to pay or otherwise compensate me or any third party in connection with the rights granted in this paragraph.6. INDEMNITY. Participant or Parent/Guardian agrees to indemnify and hold harmless Dreamers Run Club and its officers, directors, employees, or volunteers from any claims that may arise from or be related to Participant’s participation in any Event, including but not limited to all claims for compensation, medical care, or other damages, initiated by Participant or Parent/Guardian, or Participant’s or Parent/Guardian’s heirs, estate, insurers, successors and assigns. Dreamers Run Club shall have the right to recover reasonable expenses, costs, fees, and attorney and arbitration fees incurred to protect or enforce its rights under this Waiver, and any other damages allowed by law or equity.7. NO ORAL MODIFICATION. I agree that the terms of this Waiver may not be changed or waived in any respect, except by a writing signed by me and an authorized officer of Dreamers Run Club.8. SEVERABILITY. In the event that any provision of this Waiver is determined to be invalid or unenforceable, the remaining terms and conditions shall be unaffected and shall remain in full force and effect.9. ELECTRONIC ACKNOWLEDGEMENT. Participant or Parent/Guardian certificates that he or she has reviewed this Waiver, and that electronically acknowledging and/or attesting to accepting the terms of the Waiver is the legally binding equivalent of Participant’s or Parent/Guardian’s handwritten signature.This Release and Waiver shall be construed and enforced in accordance with the laws of the state of Texas ("State"), and any provisions required to be included in a release and waiver of this type by any applicable and valid federal or State law, rule, or regulation shall be deemed to be incorporated herein.10. NO DURRESS.
